Romania is preparing a new law on the employment of foreign workers, drafted by an interministerial group and expected to be finalized shortly. The new legislation will replace the current framework and is planned to take effect on 1 January 2026.
Key Changes The law will introduce simpler procedures and shorter processing times for bringing foreign workers to Romania. It seeks to correct discrepancies between issued work visas, actual arrivals, and valid work permits. Stricter rules will apply to recruitment companies to prevent cases where workers use Romanian authorizations to travel directly within Schengen or leave Romania shortly after arrival. The draft will also include stronger controls and financial guarantee requirements, with the possibility of suspending or cancelling authorizations for non-compliance. Important Notes
A foreign worker holding a Romanian work authorization may not legally work in another EU country. The new legislation aims to tighten enforcement and monitoring of this obligation.
