New Regulations on Employing Foreign Nationals in Poland – Effective May 1, 2025

On April 10, 2025, the President of Poland signed the Act on the Conditions of Admissibility of Employing Foreigners, which introduces substantial changes to the framework for employing foreign nationals in Poland. The legislation comes into effect on May 1, 2025, and places a stronger focus on enforcement, compliance, and local-level regulation.
Key Changes
Applications for work permits or declarations of work assignment may be rejected if the foreign national previously held such authorizations but did not commence employment within the past two years - unless justified by valid reasons.
A copy of the signed employment contract has to be submitted as part of the application package.
It has become a legal obligation to notify the Labor Office within 7 calendar days of termination of employment under a declaration of assignment.
Non-compliance with the new rules may lead to administrative fines of up to PLN 50,000, with additional penalties under the Polish Labour Code ranging from PLN 1,000 to 30,000.
Unannounced inspections regarding the legality of employment may now be carried out by the Border Guard or the National Labour Inspectorate (PIP).
The Labour Market Test (test rynku pracy) has been abolished. In its place, employment restrictions for foreign nationals will be determined locally at the powiat (county) level.
Applications for work permits will be rejected if the employer’s business was established or primarily operates to facilitate the entry of third-country nationals into Poland.
The government is also considering implementing a list of professions excluded from eligibility for work permits or declarations, to further tighten the regulatory framework.
Important Notes
The changes apply to new applications submitted on or after May 1, 2025.
Employer practices and applicant history will be scrutinized more closely during the application review process.
Employers must ensure accurate and timely reporting, maintain proper documentation, and demonstrate legitimate business operations to avoid rejections and penalties.
